Disini penulis blog ingin berkongsi bagaimana untuk menghasilkan satu surat tawaran kerja yang berkesan.
Sebelum menulis Surat Tawaran Kontrak Pekerjaan, andalah terlebih dahulu harus memahami beberapa akta yang disenaraikan dibawah, supaya setiap perkara yang ditulis adalah tidak bercanggah dengan peruntukan menimum yang diWAJIABkan oleh pihak berkuasa dan perundangan negara, iaitu;
1. Employement Act 1955 ( bagi semenanjung Malaysia dan wilayah-wilayah persekutuan)
2. East Malaysia Labour Ordinance ( Bagi Sabah dan Sarawak)
3. Industrial Relation Act 1955
4. Trade Union Act 1959
5. EPF Act
6. SOCSO Act
7. OSHA Act 1980
8. Wage Act 1980
9. TLOB 1980
10. Part Time Regulation 2010
Sesuatu Surat Tawaran yang ingin dikeluarkan haruslah berbeza dan mengetahui ciri-ciri tawaran yang ingin tawarkan. Terdapat empat jenis Surat Tawaran Pekerjaan yang harus anda kenalpasti, iaitu;
1. Open Term Contract
2. Fixed Term Contract
3. Part Time Employement Contract
4. Casual Employment Contract.
Setiap satu diatas ada perincian atau dihuraikan didalam Akta Kerja 1955.
Open contract shall observe the following;-
1. No stipulation of date expiry contract
2. Will be termed as "permanent" employment
3. Termination by notice only for employee
When drafting an open or fixed term contract, the following MUST be put as part a STANDARD CONTRACT TERMS
1. Job Title / Grade / Category
2. Date of commencement
3. Duration of employment
4. Salary and other monies
5. Place of work
6. Nuture of job
7. Probationary period and provisions
8. Working hours
9. Transfer and assignment provisions
10. Termination Regulations
11. Rest Day entitlement
12. Leave Entitlement
13. Holiday Entitlement
14. Dismissal Regulations
15. Work ethics regulation
16. Code of conduct regulation
17. Complaince to company handbook (if necessary)
18. Retirement clause and provision
19. Non- soliciting terms
20. Non disclosure terms
21. Statutory terms
22. Non statutory benefit entitlement
The structure of contract applies to open contract and fixed contract are same, the ONLY term that differs are the period of employment and termination procedures. In the open contract, notice of termination shall apply ONLY for employee. In a fixed contract, termination clause CAN apply to both parties - (termination simpliciter section 11 (1)).
